Child Support Issues

Child Support

In Texas Child support in is calculated on the net resources of the party responsible or ordered for paying the support (the "obligor"), taking into account the how much health insurance if they are also ordered to pay, and how many children the obligor has a duty to support. An example would be, if there are two children, and has a third child for whom she/he has a duty to support living with she/him, the calculation is 22.50% of the net resources. There are other factors that may need to be considered.

Most states have passed the Uniform Interstate Family Support Act, a law that lets courts in different states cooperates with each other and that clarifies what happens when the parties in a support case live in different states. Under this law, the state where one parent and the child live has the power to issue a support order. Other states cannot interfere with this order but must uphold the order. The court can however, modify the order if the appropriate steps are taken to do so with legal counsel.

How Does One Enforce The Order To Pay?

The very first thing you must do is to get the state involved by registering with the child support division. You may not find them to be as efficient as your paid attorney however, once they have the order in their database and you calling to help keep them up to date on the obligators living address, and where they work. The investigative part is strictly up to you to keep the state informed. They have so many to keep up with you have to stay on top by providing them with any information that changes.

It is very typical for the obligator to change address’s multiple times, but in this technical day and age, turn to your computer for help. Search for that person on all social networking sites, ask questions to their relatives, and seek out their friends. It may not seem fair, but if you stay on top of the party ordered to pay child support from the beginning, it won’t get out of hand AND, the party ordered will understand you will not tolerate them skipping on their obligations to their children.
